1. General information

All orders placed via the website www.physiocoiffeur.com (hereinafter referred to as the “Site”) are governed by these general terms and conditions of sale. These are binding and apply to the exclusion of any other conditions or agreements. They define the rights and obligations of each party.
Each customer acknowledges having read, understood and accepted these general terms and conditions of sale, without any reservation.

2. Personal data

LABORATOIRE SINTYL SA undertakes to respect the confidentiality of the personal data mentioned by customers when ordering on this website and to process them within the limits imposed by law.
When registering for the first time via this website, the customer is entitled to refuse to receive invitation or commercial communication emails from LABORATOIRE SINTYL SA. This possibility remains in force at all times.
The customer undertakes to inform personal data in order to ensure the proper processing of his order (invoicing and delivery). He undertakes to ensure that these are correct and up to date at the time of the order.

3. Coming into force of the contract

The contract comes into force as soon as the customer has entered the payment information and it has been validated on the “PHYSIOCOIFFEUR” website. The order is therefore placed.

4. Orders

The customer places an order via this website and by clicking on the button “add to shopping basket” he adds the selected product to his shopping basket. He can at any time continue his selection of items, modify his shopping cart or complete his order and pay for the product selection.
Any order placed on this site by validating the shopping cart commits the customer to purchase the selected products according to these general conditions of sale.
The customer cannot complete or cancel an order once it has been placed. No refund is made to the customer.
LABORATOIRE SINTYL SA undertakes to sell the products as presented on this website within the limits of the available stock.
Each order of a buyer will be limited to an amount of 2500CHF and the buyer will not have the right to order more than 5 products of each reference per order. In the event of an order for a higher amount or number of products, LABORATOIRE SINTYL SA invites the Purchaser to contact it by telephone on 022 343 69 16 from 9am to 5pm Monday to Friday. LABORATOIRE SINTYL SA reserves the right to cancel an order which would be presumed not to meet the above criteria, without however its responsibility can be engaged.

5. Order confirmation

Once the order has been validated and paid for, the customer receives an order confirmation information by email.
The data recorded by LABORATOIRE SINTYL SA constitutes irrefutable proof of the order or transaction carried out. All data recorded by the financial system is irrefutable evidence of financial transactions.
In the event of subsequent refusal of the payment method, LABORATOIRE SINTYL SA reserves the right to refuse or cancel the delivery, at its discretion, of any order placed on this website until payment has been made.
In addition, LABORATOIRE SINTYL SA reserves the right to sell the products to other customers capable of paying for the order if the pending payment is not paid on time (in the event of tight stocks).

6. Prices

The prices payable for the products are those displayed on this site on the date of the order VAT included in Italy, excluding delivery costs.
Shipping costs are charged in addition to the products ordered. These are visible at the time of the shopping cart summary. They are calculated according to the customer’s location at the time of the order that will be required.
LABORATOIRE SINTYL SA reserves the right to modify at any time the prices and other fees mentioned on this site.

7. Product representation

LABORATOIRE SINTYL SA undertakes to ensure that the photographs of the products as they are represented on this site correspond as closely as possible to those of reality. However, depending on the way the product is presented on the Internet, the representation made by the customer of the product may potentially differ from reality.

8. Secure payment

All payments are made using a payment card (Visa, Mastercard, American Express) and via Paypal.
The order will be considered effective after confirmation of the agreement of the bank payment centers.
In accordance with current regulations, and to ensure the security and confidentiality of their information, LABORATOIRE SINTYL SA does not store its customers’ banking data. It is therefore the customer’s responsibility to save and print his payment certificate if he wishes to keep the payment details relating to his order. Credit card data is encrypted to protect the customer.

9. Delivery

As soon as the bank confirms acceptance of the Buyer’s payment, LABORATOIRE SINTYL SA will process the order within the limits of available stocks.
Orders are delivered to the delivery address indicated by the Purchaser at the time of his order on the site. Any modification of the destination address of the order after the validation of the payment of the order will not be taken into account. Orders are delivered by a shipping company. Delivery times may vary depending on the time of the Buyer’s order and the destination of the package. These deadlines are independent of LABORATOIRE SINTYL SA, the payment of any penalty or indemnity, by LABORATOIRE SINTYL SA to the Purchaser, will not be accepted on this basis.
For information only, the order preparation time may vary from 48 hours to 72 hours, and the usual delivery time given by the shipping company is 48 hours in working days from the date of collection of the parcel.
The package thus sent will be delivered to the Purchaser without signature, or to the nearest post office in case of absence. If the Purchaser does not collect his package within the time limits indicated by the postal services on the transit advice note left in his mailbox in his absence, the package will be returned to the sender, LABORATOIRE SINTYL SA.The ordered products will be refunded (by re-crediting the credit card used when ordering) at the latest within thirty days of the return of the package to LABORATOIRE SINTYL SA.
If the package arrives damaged or opened at the Purchaser’s premises, the Purchaser must refuse its delivery by the shipping company employee by informing him of the damage noted and making a complaint to him for an anomaly. Any delivery of packages accepted by the Purchaser shall be deemed free of defects due to delivery.
A delivery note, confirming the details of the Purchaser’s order, is attached inside the package.
Underserved areas:
LABORATOIRE SINTYL SA reserves the right to restrict delivery to certain destinations. Delivery is available in Belgium, Bulgaria, Cyprus, Croatia, Denmark, Estonia, Finland, France, Greece, Hungary, Ireland, Latvia, Lithuania, Luxembourg, Malta, Netherlands, Poland, Portugal, Romania, United Kingdom, Czech Republic, Slovakia, Slovenia, Switzerland and Sweden.
Any order placed despite these restrictions may not be the subject of claims and therefore refund from LABORATOIRE SINTYL SA.

10. Verification of the goods and return

It is the customer’s responsibility to check the quantity and condition of the goods as soon as the products have been returned to him.
In the event of an error (damaged or missing product), the customer must register and inform LABORATOIRE SINTYL SA on 022 343 69 16, from 9am to 5pm Monday to Friday, within seven days of receiving his order. LABORATOIRE SINTYL SA may confirm this non-conformity and indicate the procedure for returning it at its own expense.
The products of LABORATOIRE SINTYL SA cannot be returned or refunded as long as they correspond in all respects to the order form and do not present any defect that could be charged to LABORATOIRE SINTYL SA.

11. Warranty

Without limiting the scope of these General Terms and Conditions of Sale, no claim whatsoever for delivered products, non-delivery of products or otherwise may exceed the amount of the purchase price of the products that gave rise to a claim for damages. IN NO EVENT SHALL LABORATOIRE SINTYL SA BE LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND (EVEN IF THE BIRTH OF SUCH DAMAGES WAS KNOWN OR COULD HAVE BEEN KNOWN BY LABORATOIRE SINTYL SA) ARISING IN CONNECTION WITH ITS PRODUCTS, THEIR USE, SALE OR THIS SITE.

12. Intellectual property

LABORATOIRE SINTYL SA owns the rights to this Site and all the elements, brands, logos, illustrations, texts, sound elements etc. appearing on it.
LABORATOIRE SINTYL SA does not grant any license or right other than the right to access and consult this Site.
The reproduction or use of all or part of the Site is authorized only for strictly personal and private information purposes. Any other use made without the prior written authorization of LABORATOIRE SINTYL SA shall constitute an infringement and may be sanctioned as such.

13. Computer technology and freedom

The personal data communicated by the Purchaser and collected by LABORATOIRE SINTYL SA when ordering from the Purchaser are mandatory and necessary for the processing and management of his order. The lack of information of its elements will not allow LABORATOIRE SINTYL SA to process the Purchaser’s order.

14. Miscellaneous provisions

Computer or technical problems on the Site LABORATOIRE SINTYL SA declines all responsibility in the event of interruption, malfunction or fraudulent intrusion on the Site.
LABORATOIRE SINTYL SA cannot be held responsible for any loss of data or files resulting from consulting the Site. It is the Purchaser’s responsibility to make all necessary backups before placing his order on the Site.

Force Majeure
LABORATOIRE SINTYL SA will do its utmost to fulfil its obligations but will under no circumstances be held liable for cases of force majeure or fortuitous circumstances. Thus, any delays or non-delivery resulting from circumstances beyond its control, in particular in the event of strikes, wars, natural disasters or any other circumstances that prevent the smooth production, transport or delivery of products may not be charged to the seller. In addition to the cases usually retained by the case law, the following are expressly established as force majeure or fortuitous cases: blocking of means of transport or supplies, earthquakes, fires, storms, floods, lightning; stopping telecommunication networks or difficulties specific to telecommunication networks external to customers.
In the event of delay, LABORATOIRE SINTYL SA will fulfil its obligations as soon as possible and reserves the right to distribute the remaining stocks of products among its customers in an equitable manner.

Partial Non-Validation
If one or more provisions of these general terms and conditions are recognized as invalid or declared invalid pursuant to a law, regulation or following a final decision of a competent court, the other provisions shall retain their full force and scope.
Applicable jurisdiction
These general terms and conditions of sale as well as all sales where they apply are subject to Italy law. Any dispute in connection with or arising from these general terms and conditions of sale shall be governed by Italy law.
The exclusive place of jurisdiction is Geneva.
